About these terms

These Terms & Conditions govern your use of our website and any purchase you make from us. By browsing the site, creating an account, or placing an order, you agree to be bound by them.

If you don't agree with any part of these terms, please don't use the site or place an order.

Our Privacy Policy explains how we handle your personal information and forms part of this agreement.

Who we are

We are Pure Haven Candles LLC, a limited liability company registered in New Jersey, United States, with our place of business at 34 Prospect St, Suite 10, East Orange, NJ 07017.

You can reach us at [email protected]. In these terms, “we”, “us”, and “our” refer to Pure Haven Candles LLC; “you” refers to the person using the site or placing an order.

Using our site

You may use our site for your own personal, non-commercial purposes. You must be at least 18 years old, or have permission from a parent or guardian, to place an order.

We work to keep the site available and accurate, but we don't guarantee it will be uninterrupted or error-free. We may change, suspend, or withdraw any part of it without notice.

Accounts

If you create an account, you're responsible for keeping your password confidential and for everything that happens under your account. Tell us promptly if you think someone else has accessed it.

Please keep your details accurate and up to date — we rely on them to deliver your order. We may suspend or close an account that we reasonably believe has been used to breach these terms.

Products and descriptions

Our candles, car diffusers, and room & body sprays are made by hand in small batches. Because of that, small variations are normal and are not defects:

• Colour and finish — natural coconut wax can vary slightly in tone between batches, and frosting or small surface marks are characteristic of natural wax.
• Scent strength — how strongly a scent carries depends on room size, airflow, and temperature.
• Screen colours — product photographs are as accurate as we can make them, but screens vary and colours may not be exact.

Weights and volumes shown are approximate and measured before curing.

Orders

When you place an order you're making an offer to buy. Your order is accepted only when we send a confirmation email — that's the point a contract is formed between us.

We may decline or cancel an order if:

• An item is out of stock or has been discontinued.
• There's an error in the price or description.
• We're unable to authorise your payment.
• We reasonably suspect fraud or a breach of these terms.

If we cancel an order you've already paid for, we'll refund you in full.

Need to change or cancel an order? Email [email protected] as soon as possible. We'll do what we can, but once an order has been packed we may not be able to alter it.

Pricing and payment

Prices are shown in US dollars and exclude shipping and applicable sales tax, which are calculated at checkout. New Jersey sales tax is applied where required.

Payments are processed by Stripe. We don't receive or store your full card details. By submitting payment information you confirm you're authorised to use the payment method.

We take care with pricing, but if an item is listed at an obviously incorrect price we'll contact you before shipping and give you the choice of paying the correct price or cancelling for a full refund.

Promotional codes can't be combined unless we say otherwise, have no cash value, and may be withdrawn at any time.

Candle safety and proper use

Our products contain an open flame or are intended for use on skin and surfaces. By purchasing, you agree to use them safely and in line with the instructions supplied with each item and printed on the label.

Candles and tin candles

• Never leave a burning candle unattended, and never burn one near anything that can catch fire.
• Keep away from children, pets, and drafts.
• Trim the wick to about a quarter inch before every burn.
• Burn on a stable, heat-resistant surface, and never burn for more than four hours at a time.
• Stop use when about half an inch of wax remains.
• Containers become hot — never move a candle while it's lit or the wax is molten.

Sprays and car diffusers

• For external use only. Do not ingest, and keep away from eyes.
• Patch test body spray before wider use if you have sensitive skin.
• Some fragrance oils can mark finishes — test on a hidden area before spraying fabrics or surfaces.
• Secure car diffusers so they can't obstruct driving or fall while the vehicle is moving.

Intellectual property

All content on this site — the Pure Haven Candles name and logo, product names, photography, illustrations, text, and page design — belongs to us or our licensors and is protected by copyright and trade mark law.

You may view and print pages for your own personal use. You may not copy, republish, sell, or use our content or branding commercially, or use our product photography in your own listings or advertising, without our written permission.

Reviews and customer content

When you post a review, comment, or photo, you keep ownership of it but grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it in connection with our business, including on our site and social media.

You confirm the content is your own, is accurate, and doesn't infringe anyone else's rights. We may edit or remove content that is unlawful, offensive, misleading, or off-topic — but we don't have to monitor it, and reviews reflect their authors' opinions, not ours.

Prohibited uses

You agree not to:

• Use the site for any unlawful or fraudulent purpose.
• Buy products for resale without our written agreement.
• Introduce viruses or other harmful code.
• Attempt to gain unauthorised access to the site, its servers, or another user's account.
• Scrape, harvest, or copy content by automated means.
• Interfere with the proper working of the site.

We may restrict or terminate your access if you breach this section.

Disclaimers

Our site and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these terms, including implied warranties of merchantability and fitness for a particular purpose.

Nothing on our site is medical or therapeutic advice. Our products are home fragrance and personal care items; they are not intended to diagnose, treat, cure, or prevent any condition.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses, including loss of profit, revenue, or data, arising from your use of the site or our products.

Our total liability in connection with any order will not exceed the amount you paid for that order.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Pure Haven Candles LLC, its members, and its staff against any claims, losses, or reasonable legal costs arising from your breach of these terms, your misuse of our products, or your violation of any law or third-party right.

Governing law

These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

If any provision of these terms is found unenforceable, the remaining provisions continue in full effect.

Changes to these terms

We may update these terms from time to time. The date at the top always shows the current version, and the terms in force when you place an order are the ones that apply to that order.

Continuing to use the site after a change means you accept the updated terms.
